The BBC Hausa service in a counter affidavit presented to the Federal High Court in Kano argued that since the plaintiff quantified his claim into monetary terms, there is no need for the court to give the order of interim application to stop the use of the soundtrack.
A Kano-based musician sued the BBC Hausa Service for using his sound track in their popular programme “Daga Bakin Mai ita”’ without his consent.
In their motion on notice the plaintiff counsel, Barrister Bashir Ibrahim, argued that their prayer asking the court to award damages against the defendant was in order as one cannot go to the court without a specific prayer that he wants the court to grant for him.
“’Court is not a father Christmas, you cannot go to the court bare handed without mentioning what you want the court to do for you.
“’We initially filed an application for the court to stop the dependent from using our sound track”, the lawyer said
The presiding judge, Justice N. M Yunusa, adjourned the case to 12 February 2024, for continuation of the case.
